Before making a booking with us, you must ensure that you have carefully read and understood the following terms and conditions that govern our services. We are at your disposal to answer any questions you may have.
The terms and conditions of Seko Tours Adventures apply to all booked trips and prevail in all situations unless otherwise specified.
Seko Tours Adventures Terms and Conditions
Seko Tours Adventures is registered in Tanzania as a licensed tour operator.
The T&C outlined below are specific to the services provided by Seko Tours Adventures (hereinafter referred to as “Seko Tours Adventures”, “STA”, “we” and “us”) to you, our client (hereinafter referred to as “client” “traveler”, and “you”, the lead booker, as well as the booking party), and the use of its website, social media pages, mobile app and online portals.
1. Privacy and Data Protection
We are committed to protecting your privacy and handling your personal data in accordance with our privacy policy. By using our website and contacting us via provided channels, you consent to the collection, use, and disclosure of your personal information as described in our privacy policy.
2. Modification of our Terms & Conditions
We reserve the right to modify and/or update our terms and conditions at any time. Any changes will be effective immediately upon posting them on our website. By continuing to use our website after such changes, you agree to be bound by the modified terms. If we revise our terms and conditions, our clients who have already made a booking will receive an email about this. The revised terms and conditions will automatically apply from that time, unless a written objection is made by the client within two weeks.
3. Intellectual Property
The content, logos, trademarks, and other intellectual property on our website are owned by or licensed to Seko Tours Adventures and are protected by applicable intellectual property laws. You may not use, reproduce, modify, distribute, or display any of our intellectual property without our prior written consent.
4. Prices
4.1 Website Pricing
All prices published on our website are per person (unless otherwise stated) and quoted in US Dollars (USD$). Cost of obtaining passports or visas, border taxes (if applicable), tips for guide, driver and hotel staff, insurances, additional excursions or personal expenses are not included in the itinerary cost. Discount rates for children or peak-rates during the high/festive season are not included. All prices on the website should be used as a guideline only. Seko Tours Adventures cannot be held responsible for any changes or pricing errors. Seko Tours Adventures will provide actual costs in its quotation proposals. The quotations are valid for 3 weeks and interim proposal changes are subject to overall travel package price changes.
4.2 Surcharges
Matters influencing a surcharge would include, but are not limited to, increases in transportation costs (e.g. fuel, scheduled airfares and any other airline surcharges, taxes or fees payable for services such as landing taxes, or embarkation or disembarkation fees at ports or airports), increases in park fees, reserve fees or concession fees, or exchange rates which are relevant to the travel package. The price of your itinerary will be based on known costs at the date of issue of the itinerary. From the date of the conclusion of the package travel agreement up to 20 days before commencement of the travel package, STA reserves the right to levy a surcharge where costs have changed since the date of issue of the itinerary. Should the surcharge exceed 10% of the total holiday price, you are entitled to cancel the holiday and receive a full refund of all monies paid. We reserve the right to make changes to and correct errors in advertised prices at any time before your holiday is confirmed. We will advise you of any errors of which we are aware and of the then applicable price at the time of booking.
Clients must accept that conditions in some African countries are not the same as those in developed countries. There is always the possibility of unannounced and sudden changes in government regulated fees and taxes, such as national park fees and taxes. Seko Tours Adventures has the right to pass these local taxes/fees on to their clients.
5. Booking, Payments and Cancellations
5.1 Booking Confirmation
After a client requests a quote on our website, we promptly send a comprehensive itinerary to their email address. This detailed itinerary outlines the various destinations they will visit, the activities they will do and accommodations where they will stay, allowing them to gain a clear understanding of what to anticipate. Following this, it is imperative for the client to either confirm their acceptance of the proposed itinerary or provide suggestions for any modifications they desire.
The safari services agreed upon with the client throughout this process will be diligently provided, except in the event of unforeseen circumstances, such as road closures, bad weather, or security concerns. In such cases, the itinerary may be changed or terminated (see sections 5.3.2. and 6.2.).
5.2 Payment
Payments can be made by bank wire/transfer, debit or credit card as well as other direct card payments.
After clients accept a proposal, they receive an invoice with all details. We require a non-refundable deposit of 25% for camping safaris, trekking tours and Kilimanjaro or other climbs within 14 days of receiving the invoice. The non-refundable deposit for lodge safaris or hotel reservations is 50%. In case you booked only an accommodation with Seko Tours Adventures you will need to pay the full price upon confirmation. We require 100% upfront payment if the booking was made within 61 days prior to departure. We cannot guarantee a booking if a deposit or a full amount is delayed.
If clients book international airline tickets with us, we require 100% payment within a specified reservation deadline.
In both cases, full payment must be made no later than 8 weeks (2 months) before the departure date. Failure to make full payment by this deadline gives us the right to cancel the holiday and apply the applicable cancellation charges (refer to section 5.3.1). The travel agreement will then be automatically dissolved and you will receive a notification prior. In such cases, we bear no liability and cancellation is without penalty to us. The lead booking name is responsible for full payment on behalf of the entire party, and all members agree to the stated conditions. The lead booking name is severally responsible for all duties resulting from the agreement.
Deadlines for last-minute trips: For last minute reservations and bookings, less than 2 weeks before arrival, you will have to pay the remaining balance in cash (USD) at arrival and before your tour starts. Lodges and hotels are excluded from this rule, where full payment is necessary for a reservation.
Payments in currencies other than USD: Since all of our services are to be paid in USD to our suppliers, Seko Tours Adventures is subject to exchange rate fluctuations. It may happen that, at the time of payment, the exchange rate has changed from the time of confirmation. In this case, Seko Tours Adventures reserves the right to pass on the exchange rate difference to its clients.
5.3 Cancellations and/or Refunds
5.3.1 Cancellation by the Client
If you have to cancel your booking before departure, you must notice Seko Tours Adventures in writing. The day we receive and confirm your written cancellation is considered as the cancellation date. All cancellations will be charged with a cancellation fee, depending on the number of days before the departure date:
- 41 – 60 days: 30% of total invoice
- 31 – 40 days: 40% of the total invoice
- 21 – 30 days: 50% of the total invoice
- 11 – 20 days: 60% of the total invoice
- 02 – 10 days: 70% of the total invoice
- Within 48 hours and after commencement of holidays: 100% of the total invoice, no refund
5.3.2 Cancellation by STA
Whilst we always endeavor to avoid cancellations, we reserve the right to cancel your holiday for the reasons and respecting the deadlines specified below.
Reasons:
- If you don’t comply with your duty to pay the travel sum
- If we have a legitimate fear that you will not or not fully pay the travel sum, before payment has become claimable
- When, on a date specified in the agreement, it becomes clear that the minimum number of participants is insufficient
Deadlines:
- For trips of more than 6 days: termination will have to be done not later than 20 days before departure
- For trips of 2-6 days: termination will have to be done not later than 7 days before departure
- For trips of less than 2 days: termination will have to be done not later than 48 hours before departure
We may also be entitled to cancel your holiday during your trip if you fail to comply with local laws, tours, carriers and accommodations regulations.
6. Modifications
6.1 By the Client
After your booking has been confirmed, should you wish to correct any errors, make any changes to your itinerary or your arrival date, or replace a traveler, we will make every effort to accommodate your requests based on the below conditions and availability.
Modifications allowed within 10 days of booking confirmation:
- Errors in the reservation: Please carefully read your confirmation email, invoice, tickets and all other documentation we send you as soon as you receive them. If you identify any necessary modifications within 10 days (such as a misspelled name), please inform us promptly to avoid any charges. However, after the ten-day period, we are obliged to apply a modification fee of $100. Modifying international flight tickets invariably incurs additional fees, regardless of the nature or timing of the changes.
Modifications allowed 60+ days before departure:
- Itinerary route, activities and accommodations: If your departure date is beyond 60 days and provided that the required deposit has already been paid, you can request to modify the activities, accommodations, and route of your itinerary. This will result in an administrative fee of $100 per person, in addition to any other fees such as cancellation penalties, airline fees, hotels or local operators.
Modifications allowed up to 7 days before departure:
- Replacing a traveler: You may request that we replace a traveler with another person, subject to availability and payment of administrative costs and any additional fees.
We cannot make alterations to your confirmed itinerary, for any reason whatsoever, within 60 days of departure and any such request will be treated as cancellation of the original booking and will be subject to the cancellation charges set out in section 5.3.1.
6.2 By STA
We reserve the right to alter any arrangements or cancel a scheduled operation should it be obligatory in case of air schedule, poor road conditions, weather conditions, security matters, border closures or any other reason beyond our control. The local conditions in Africa are not always predictable and from time to time delays and diversions from the planned route can happen.
7. Insurances
We most strongly advise you to arrange adequate comprehensive travel and medical insurance for themselves, as well as any dependents/travelling companions, throughout their trip. The travel insurance should cover medical expenses and repatriation, personal accidents, tour cancellation and any kind of loss. Make sure your insurance is aware what kind of tour you are going to undertake.
8. Medical Conditions and Disabilities
We advise that persons not fit enough for such long, adventurous and rigorous trips due to chronic illness, heart disease, physical handicap, mental illness or advanced pregnancy should not participate in these travel programs. Seko Tours Adventures also reserves the right to accept or retain participation for any person on a tour at any time, if we consider someone unsuitable for the trip.
If you or any member of your party have any medical problem or disability which may affect your holiday, please inform us before you confirm your booking so that we can advise as to the suitability of the chosen arrangements. In any event, you must give us full details in writing at the time of booking.
9. Travel Documents
9.1 Passports, Visas, Vaccination Documents
It is upon the traveler to ensure that passports and visas are valid for the countries visited. Clients from other countries traveling to Tanzania are obligated to carry proper documentation showing their citizenship, such as a passport. You may also be asked to bring a vaccination passport. Make sure to carry a valid vaccination passport with the right vaccinations and/or approvals as you may be denied access to Tanzania if these documents can’t be provided. Passports should be valid for at least six months after leaving Tanzania.
Seko Tours Adventures cannot be held liable for any impediment suffered by a traveler as a result of failure to possess proper and complete travel documents or costs involved with obtaining them.
9.2 Others
We send you all vouchers (where applicable), domestic e-tickets, between two weeks and three days before departure.
10. Carriers
Carriage by air and sea, international or domestic, is subject to the terms and conditions of the carriers with whom you are traveling and to international conventions. STA accepts no liability to offer compensation whatsoever for cancellations, strikes, timetable changes, diversions, technical issues unrelated to STA, lost or mislaid luggage, rescheduling costs, missed accommodation, or delays which result from any operational decision of the carrier concerned, even when we did make the ticket booking.
11. Risks
You acknowledge that participation in our travel products involves inherent risks associated with the wilderness, the environment, health, transport and personal safety, which you voluntarily assume. The possible risk factors and inherent dangers include, but are not limited to, risks of climbing, hiking mountains, equipment failures, walking safaris, trail obstructions, and on all safaris dangers of animals, difficulty in evacuation from remote locations in case of a medical emergency and inaccessibility to medical care.
Seko Tours Adventures will make reasonable efforts to provide you with guidance on weather conditions, safety considerations, physical challenges, health formalities, local customs, and applicable laws and regulations in the areas visited.
12. Limitations of Liability
STA accepts responsibility for ensuring your holiday is executed as described prior to your departure and services provided will reach a reasonable local standard. However, Seko Tours Adventures, its agents and sub-contractors act only as the passenger’s agents in matters relating the tours, itineraries, hotel accommodation, transportation etc., and shall not in any way be liable for injury, death, illness, delays, or other damages arising from circumstances beyond our control.
The company’s liability towards passengers carried in their own vehicles is under domestic law of the country where the safari takes place. The liability of STA for damages you suffer is limited to three times the travel sum.
13. Problems During Your Trip
If you have any complaints while on tour, you must talk to the guide, personal assistant, the supplier of the service or other local representative to clarify any problems or situation. Should you upon departure still remain dissatisfied, feel free to send us a detailed complaint about the problem within 28 days of the end of our services mentioned in the contract.
14. Local Laws and Regulations
Throughout the trip, you must adhere to all applicable local laws as well as regulations of tours, carriers and accommodations. Clients whose trip includes a visit to one or more National Parks and/or Conservation Areas need to follow the rules and restrictions of the individual National Park and/or Conservation Area.
15. Baggage Restrictions
Our safari vehicles have limited space, so baggage and luggage is restricted to one normal size suitcase, soft bag or backpack per person. Baggage weight on all scheduled flights within the parks and trekking trips is limited to one bag of 15 kg per person.
16. Photography
Seko Tours Adventures reserves the right to take photos, film material and images of its travels and individual participants while on tour. The clients and tour participants grants Seko Tours Adventures all permission to do so and to use the material for commercial or promotional purposes.
17. Force Majeure
Force majeure means any event which we or the supplier of services in question could not even with all due care foresee or avoid. Such events are likely to include, but are not limited to, war, threat of war, civil strife, riot, civil disorder/unrest, industrial dispute, actual or threat of terrorist activity, natural or nuclear disaster, fire, floods, breakout of an epidemic or pandemic disease, technical problems with transport, cancellation or amendment to any scheduled flight, closure or congestion of airports or ports, adverse conditions and all similar events outside our control.
18. E-mails
Sometimes it also might happen that your e-mail does not reach us. If you do not receive any answer from us within 3 working days, we advise you to resend your e-mail again.
19. Contract
Your contract is with Seko Tours Adventures. Making a booking with Seko Tours Adventures is regarded as acceptance by the lead client and all parties of the group of the above terms and conditions before the contract between us comes into existence. The client must be over 18.
By making a booking of a travel package, a package travel agreement comes into existence between you and STA. The booking confirmation is the contract between you and STA. This document is the proof of the existence and content of the package travel agreement. Minors are not allowed to make a booking.
20. Jurisdiction
Tanzanian law is applicable to the agreements that have been concluded, amended or supplemented on the basis of these terms and conditions, unless on the grounds of mandatory rules other law is applicable. Tanzanian courts are competent to take decisions on disputes arising from these terms and conditions.
